1. GENERAL ACCESS AND CONTENT
This Portal is owned and maintained by Chubb. Chubb is composed of insurance and reinsurance companies that are licensed or otherwise approved to transact insurance and/or reinsurance business in various countries and jurisdictions around the world. Chubb also includes companies that provide services to the insurance industry and other customers.
These T&Cs may be changed, modified, supplemented or updated by Chubb from time to time without advance notice. Unless otherwise indicated, any new Content added to this Portal will also be subject to these terms effective upon the date of any such addition. You are encouraged to review the Portal periodically for updates and changes.
The Content contained on this Portal is not for use within any country or jurisdiction or by any persons where such use would constitute a violation of law or regulation. If this applies to you, you are not authorized to access or use any of the information on this Portal.

2. DEFINITIONS
In these T&Cs, the following terms shall have the meanings set forth below:
3. GRANT OF LICENCE
3.1 Chubb grants the Licensee a limited, non-exclusive, non-transferable, non-sublicensable and revocable Licence to access and use the Portal solely for the purpose of viewing client insurance policies and related information.
3.2 You acknowledge that the Licence is granted under these T&Cs subject to the following stipulations:
3.3 Chubb reserves the right to immediately revoke your access to the Portal and terminate your Licence, without prior notice, in the event of any breach of these T&Cs or if Chubb reasonably suspects fraudulent, unauthorized, or unlawful activity.
3.4 A Licence terminates upon notification by Chubb to a Licensee or automatically by natural expiry, such as when a Licensee leaves their role or employer and has no further need or right to access the Portal. A Licensee may also terminate their Licence at any time by providing written notice to Chubb. Following termination by either party or expiry of a Licence, a former Licensee must securely dispose of their Credentials and any offline Content they have acquired from the Portal (as permitted by these T&Cs) and must not access the Portal.
4. USE OF THE PORTAL
4.1 Permitted Use:
The Licensee shall use the Portal in accordance with the licence granted under these T&Cs and applicable laws.

4.4 Credentials and Security:
Chubb shall provide each Licensee with Credentials. You must not disclose your Credentials to anyone, and you must take all reasonable steps to prevent unauthorised access to the Portal through use of your Credentials (such as exiting completely from your Account at the end of each session). You may not use anyone else's Credentials or Account, with or without the permission of the account holder.
You agree to immediately notify Chubb of any unauthorized use of your Credentials or any other breach of Portal security of which you become aware.
You shall be responsible for all activities that occur on your Account. Chubb shall not be liable for any loss that you may incur resulting from someone else using your Credentials or Account, with or without your knowledge.
4.5 Monitoring Rights:
Chubb reserves the right to monitor use of the Portal at any time, as it deems appropriate, and to take any action to restrict or mitigate conduct that, in Chubb’s reasonable opinion, may be illegal, may subject Chubb to risk or liability, may violate these T&Cs, or is inconsistent with the purpose of the Licence.
5. DATA PROTECTION
5.1 Compliance with Data Laws:
Both parties agree to comply with applicable data protection laws. The Parties shall function as independent controllers of Personal Data.
5.2 Processing of Personal Data:
The Licensee may process Personal Data accessed through the Portal for the purposes expressly permitted under these T&Cs.
Chubb shall handle any Personal Data processed under these T&Cs in accordance with its applicable Privacy Statement, available on the Portal and at Chubb.com.
5.3 Data Breach Notification:
The Licensee shall promptly notify Chubb upon becoming aware of any accidental or unauthorised access to or loss of Personal Data.
5.4 Cookies and Tracking Technologies:
The Portal may use cookies and other tracking technologies to enhance user experience and for analytics purposes. You may manage your cookie preferences through the Cookie policy on the Portal.
6. SERVICE AVAILABILITY AND LIMITATIONS
6.1 Service Availability:
The Portal has been prepared by Chubb as a convenience to Licensees. Chubb shall use reasonable endeavours to ensure that the Portal is available during usual business hours, subject to scheduled maintenance or unplanned events. However, Chubb makes no warranty or representation as to the availability of the Portal and accepts no liability for any unavailability. Chubb shall be under no obligation to provide notice, advanced or otherwise, of any maintenance or other issue resulting in downtime.
6.2 Service Limitations:
Chubb has used reasonable efforts to ensure Content made available through the Portal is accurate and complete, but makes no warranty or guarantee about its accuracy, completeness, or adequacy. All Content is provided on an ‘as is’ basis.
6.3 Content Availability:
You are responsible for maintaining your own access to data or information that may include Content, independent from your use of the Portal. Chubb shall not be liable for any loss, deletion, or corruption of Content on the Portal, regardless of the cause.
7. OWNERSHIP AND INTELLECTUAL PROPERTY

Except as otherwise expressly stated, all Content appearing on this Portal is the copyrighted work of Chubb or third party content suppliers and are protected by U.S. and applicable international copyright laws.

The domain name for this Portal, the Chubb logos, all page headers, custom graphics, and button icons are service marks, trademarks, logos, and/or trade dress of Chubb. All other trademarks, service marks, trade dress, product names, company names or logos, whether registered or not, on the Portal are the property of their respective owners. In addition to complying with all applicable laws, you agree that you will not use any of these trademarks, service marks, trade dress, or other logos from this Portal without the prior written authorization of their respective owners.

Your use of External Sites is subject to their respective terms and conditions, privacy and other applicable policies. By clicking on hyperlinks, you acknowledge that you are leaving the Portal and accessing External Sites; this transfer may not always be apparent, particularly if the External Site is owned and operated by Chubb. You are therefore advised to be aware of and review the terms and policies of External Sites after clicking on hyperlinks in the Portal.
8.3 Third Party External Sites:
Chubb does not have control over the content, terms, policies or practices of third party External Sites and does not accept responsibility or liability for any content, material or information available on or through them.
9. LIMITATION OF LIABILITY
9.1 TO THE MAXIMUM EXTENT PERMISSIBLE BY LAW, CHUBB WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES OR LOSSES, EVEN IF CHUBB HAS BEEN ADVISED OF THE POSSIBILITIES OF THOSE DAMAGES OR LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PORTAL, CONTENT OR YOUR ACCOUNT. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE PORTAL IS PREDICATED UPON YOUR WAIVER OF ANY RIGHT TO PURSUE CHUBB OR ITS AFFILIATES DIRECTLY OR TO PARTICIPATE IN A CLASS ACTION SUIT FOR ANY LOSSES OR DAMAGES RESULTING FROM YOUR USE OF THE PORTAL.
9.2 These exclusions and limitations under do not apply to liability arising from death, personal injury, or fraud or where they are expressly not permitted under any applicable laws.

10. GOVERNING LAW AND JURISDICTION
10.1 These T&Cs shall be governed by and construed in accordance with the laws of Switzerland.
10.2 Any dispute that may arise from or in connection with these T&Cs shall be subject to the non-exclusive jurisdiction of the courts of Switzerland.
10.3 If any provision of these T&Cs is deemed by a court of competent jurisdiction to be unlawful or unenforceable, it will not affect the validity and enforceability of the remaining provisions.
11. GENERAL
11.1 Entire Agreement:
These T&Cs, Chubb’s Privacy Statement, and any other policies or terms Chubb may post on the Portal from time to time constitute the entire agreement between Chubb and Licensees in connection with their use of the Portal and supersede any prior such agreements between the parties (including prior versions of these T&Cs).
11.2 International Users:
The Portal is controlled and operated centrally by Chubb but may be accessed by Licensees in jurisdictions within and outside of the European Union, including on a cross-border basis. Chubb makes no representation that the Portal is appropriate or available for use in any specific jurisdiction or that access to the Content from any specific jurisdiction is compliant with all applicable laws. Licensees are responsible for ensuring that their access to the Portal is conducted in accordance with applicable laws, including laws protecting the processing and cross-border transfer of Personal Data.
11.3 Notices:
All notices under these T&Cs must be in writing and sent to the email address associated with an Account (for a Licensee) or to the email address in the Portal footer (for Chubb).
