IMPORTANT INFORMATION ABOUT THIS COVER

This document sets out the terms and conditions relevant to the Insured Person(s) of PurchaseOne Protection which will be available to all Insured Person as defined. It is important that the Insured Person keeps it in a safe place as evidence of coverage. The PurchaseOne Protection policy explains the nature of the arrangement and its relevant benefits and risks. 

Insured Person should read the PurchaseOne Protection policy carefully. Any reimbursement made to the Insured Person will be bound by the definitions, terms and conditions, exclusions and reimbursement procedures set out in this document. 

Please keep detailed particular and proof of loss including, but not limited to, sales receipt and card statement showing purchase transaction. 

The Insurer 

The insurer is Chubb Insurance Hong Kong Limited (Chubb/We/Us/Our). Our contact details are on the back page of this Policy Wording

PART 1: DECLARATION

In consideration of the payment of a premium to The Company and subject to the terms and conditions of this policy, The Company agrees to provide cover in the manner and to the extent set out in this policy.

If this policy contains incorrect information, please return it to The Company immediately for correction.

PART 3: DEFINITIONS

The following defined terms shall have the meaning set out as follows in this policy:

  1. Accidental Damage means sudden, unforeseen, unexpected or unintentional external forces, including dropping, fire and water contact, cause destruction to Your purchased item which prevents correct operation.
  2. ATM means automatic teller machines
  3. Burglary or Robbery means taking Your Eligible Item without Your permission and with the intention of permanently depriving You of it.
  4. Claim means a request by the Insured Person for any of the entitlements and benefits under this policy.
  5. Commencement Date means the date The Company agrees to provide insurance under the policy and which is shown on the Policy Schedule.
  6. Delivery Company means the company which is responsible for the final shipment delivery to the Insured Person.
  7. Eligible Card means designated credit card issued by the DBS Bank (Hong Kong) Limited and owned by an Insured Person.
  8. Eligible Item means an item:
    i. That is purchased after the successful enrolment of this policy (In the event of any dispute or difference arising out of, or in connection with, the application time of this policy, the time stamp recorded on Our system shall prevail and be final); and
    ii. That is purchased solely for personal use; and
    iii. That is new and has not been used when purchase; and
    iv. That is purchased through Retailer or Seller; and
    v. The cost of which has been directly charged to an Eligible Card.
  9. Excess means the first amount of the loss which the Insured Person must pay if the Insured Person has a Claim and We will only be liable for the amount which is over and above that amount (up to the Sum Insured specified in the Schedule of Benefits). It applies to each loss or claims.
  10. Hong Kong means the territorial limits of the Hong Kong Special Administrative Region of the People’s Republic of China.
  11. Insured Person/Policyholder/You/Your means credit card holder of the Eligible Card and who:
    • Have an Eligible Item paid for outright in a single transaction and full payment using Eligible Card; and/or
    • Have an Eligible Item paid on a monthly contract/subscription plan by using Eligible Card, switching from an alternative payment method to Eligible Card will be excluded; and
    • is aged 18 or above; and
    • is a legal Hong Kong resident.
  12. Minimum Value means the minimum requirement of the Eligible Item on the original purchase price.
  13. Pair or Set means a number Eligible Items used together or associated as being similar or complementary.
  14. Period of Insurance means the period to which this insurance applies and for which premium has been paid starting from the Commencement Date or the latest Renewal Date, for twelve (12) calendar months.
  15. Policy Schedule means the schedule which The Company shall send to the Policyholder at the commencement of this policy, which sets out the Sum Insured for each Insured Person under this policy and which may be amended or replaced by The Company from time to time.
  16. Public Place means but is not limited to, shops, buses, planes, trains, taxis, airports, bus depots, hotel foyers, restaurants, cafes, beaches and any place that is accessible by the public.
  17. Renewal Date means the date exactly twelve (12) calendar months after the Commencement Date and the same date in each consecutive year thereafter.
  18. Replacement Cost means the cost of replacing or repairing of the Eligible Item.
  19. Retailer or Seller means a trade registered company that sells goods directly to consumers in retail stores, online store, virtual store or telephone marketing.
  20. Schedule of Benefits means the schedule of benefits in Part 2 of this policy.
  21. Sum Insured means in relation to each benefit available to an Insured Person under this policy, the maximum amount per policy year stated in the Schedule of Benefits or any endorsement(s) corresponding to that benefit.
  22. The Company/We/Us/Our means the insurer, Chubb Insurance Hong Kong Limited.
  23. Unattended means when Your possessions are not under Your observation and within Your reach and/or Your possessions can be taken without You being able to prevent them from being taken.
  24. Unauthorised Transaction means the transaction which is carried on Eligible Card without Your permission.

PART 4: DESCRIPTION OF COVER

Section A: Purchase Protection

In the event of Accidental Damage or lost due to Burglary or Robbery to Eligible Item within ninety (90) days from the purchase date, We will pay the Replacement Cost of the Eligible Item, up to Sum Insured stated in Schedule of Benefits.

Terms and Conditions and Claim Provisions to Section A:

  1. A Minimum Value of HKD 500 is required for the Eligible Item.
  2. You must report to the police or relevant authority within twenty-four (24) hours of the incident occurring and retain documentary evidence, such as a police investigation report for support of a Claim.
  3. You must report any Claim to Us as soon as You can and within thirty (30) days of the incident occurring.
  4. You will be asked to disclose the nature of the incident or incident reason arising to the Claim and You must complete and submit a claim form upon request.
  5. You may be required to send the Eligible Item to Us.
  6. The settlement method will be at Our discretion and the Eligible Item provided will be on a like for like basis.
  7. An Eligible Item must have been paid in full or paid on a monthly contract/subscription plan.
  8. Claim made for an Eligible Item belonging to a Pair or Set will be paid to You up to the original purchase price of the Pair or Set, provided the items are not useable individually and cannot be replaced.
  9. Eligible Item left Unattended in a Public Place and which are not subsequently recovered shall not constitute as being Burglary or Robbery.
  10. In the event of a Claim, You must provide Us with copies of invoices and/or receipts relating to the Eligible Item verifying the items were charged to Your Eligible Card, You may be asked to send Us the Eligible Item or provide Us the receipt as proof of mailing/shipping.
Section B: Buyer’s Protection

We will pay for the loss of the Eligible Item up to Sum Insured stated in Schedule of Benefits, in the event that the Eligible Item (a) does not arrive within thirty (30) days from the scheduled arrival date provided by the Delivery Company or the Retailer or Seller has confirmed and proven that the Eligible Item could not be found; or (b) does not match the description of the Eligible Item by the Retailer or Seller.

Terms and Conditions and Claim Provisions to Section B:

(a)     In the event the Eligible Item does not arrive:

  1. A Minimum Value of HKD 500 is required for the Eligible Item.
  2. Insured Person will be asked to provide the updated delivery information, proof of postage and tracking information from the Delivery Company or Retailer or Seller.
  3. An Eligible Item must have been paid in full or paid on a monthly contract / subscription plan.
  4. In the event of a Claim, You must provide Us with copies of invoices and/or receipts relating to the Eligible Item verifying the items were charged to Eligible Card, You may be asked to send Us the Eligible Item or provide Us the receipt as proof of mailing/shipping.
  5. If You are dissatisfied with the response by the Retailer or Seller and have not been offered a refund by the Retailer or Seller, then You have to report the Claim to Us within thirty (30) days from this point; all the evidence will be reviewed and determine if the Claim is valid. You may be asked to provide the following evidence but not limited to:
    i.     Information of the Retailer or Seller;
    ii.   Proof of Your initial investigation by contacting the Retailer or Seller.
  6. If You are unable to contact the Retailer or Seller, You must report to the police or the relevant local authority, in order to reserve Your right of a refund against the Retailer or Seller.  
  7. If the Claim deemed successful, the original purchase price of the Eligible Item will be reimbursed up to the maximum benefit amount under this section as shown in the Schedule of Benefits, whichever is the lesser. 

(b)     In the event the Eligible Item does not match Retailer or Seller’s description:

  1. A Minimum Value of HKD 500 is required for the Eligible Item.
  2. An Eligible Item must have been paid in full or paid on a monthly contract/subscription plan.
  3. You may be required to send the Eligible Item to Us.
  4. You need contact the Retailer or Seller to address the issue if the Eligible Item does not match the description of the Eligible Item by the Retailer or Seller. The Retailer or Seller should offer You a solution, such as accepting a return at the Retailer or Seller’s expense or offering a replacement or refund.
  5. If You are dissatisfied with the response by Retailer or Seller and does not offer a refund, then You have to report the Claim to Us within thirty (30) days from this point; all the evidence will be reviewed and determine if the Claim is valid. You may be asked to provide the following evidence but not limited to:
    i.       Description of the Eligible Item;
    ii.      Information of the Retailer or Seller;
    iii.     Proof of Your initial investigation by contacting the Retailer or Seller.
    iv.      Proof of the discrepancy to the description of the Eligible Item by the Retailer or Seller.
  6. If We deem the Claim to be successful, We will reimburse the original purchase price of the Eligible Item to You up to the maximum benefit amount under this section as shown in the Schedule of Benefits, whichever is the lesser.   

Exclusions under Section A & Section B:

We will not pay any benefit for:

1.     Any Claim for malicious damage.
2.    Any loss of Eligible Item which is not reported to the police within forty-eight (24) hours or failed to provide a police investigation report. (Applicable to Section A only)
3.    Any loss of Eligible Item which is left Unattended in a Public Place.
4.    Any wear and tear to the Eligible Item.
5.    Any damage to Eligible Item caused by product defects or product recalls that are covered by manufacturer’s warranty.
6.    Any loss or damage to Eligible Item in a vehicle where the items are on view regardless if the vehicle is locked or unlocked.
7.     Any Eligible Item that Retailer or Seller has accurately described.
8.    Any Eligible Item sent to another address other than the address stated on the delivery note.
9.    Any Eligible Item such as:
        i.         Counterfeit or pirated goods.
        ii.       Motor vehicles, motor cycles or motor scooters, watercraft, aircraft and any equipment and/or parts necessary for its operation and/or maintenance.
        iii.      Second hand/ used goods.
        iv.      Cash or its equivalents, traveller’s cheques, tickets or negotiable instrument.
        v.        Firearms, animals, living plants or perishable goods.
        vi.      Sports equipment whilst in use.
        vii.    Aircraft or aerial device, excluding non-pilotable model aircraft or toy kites.
        viii.   Electronic data.
        ix.      Food items.
10.    Confiscation or destruction by any government, customs or public body.
11.    Any Eligible Item purchased from a natural person through a private transaction.
12.    Any damage due to any modifications that have been made after purchase.
13.    Failure to provide proof of loss or damage.
14.    Any loss claimed under both Section A – Purchase Protection and Section B – Buyer’s Protection.
15.    Any tax, insurance cost or surcharge.
16.    Any loss that can be compensated from other sources.
17.    Any Eligible Item which is not under the name of Insured Person.
18.    Any future earned value or income of the Eligible item.
19.    Any defect or discrepancy of the Eligible Item which had mentioned at the time of purchase.

Excess applicable to Section A & Section B:

An Excess will be deducted for each and every successful Claim. The Excess due is shown in the Schedule of Benefits.

Section C: Card Theft & Loss

In the event Your Eligible Card is lost due to burglary, theft or stolen, We will reimburse You for any Unauthorised Transaction within twenty-four (24) hours prior to You first reporting the loss of the Eligible Card to the Eligible Card issuer, provided that You are required by the Eligible Card issuer to be responsible for the Unauthorised Transaction.

In the event Your Eligible Card is lost due to burglary, theft or stolen:

  1. You are required to report the loss of the Eligible Card to the Eligible Card issuer within twenty-four (24) hours of discovery of the burglary, theft or stolen.
  2. You are required in the first instance to contact the Eligible Card issuer and query any Unauthorised Transaction to Your Eligible Card.
  3. If after the investigation by the Eligible Card issuer, it is confirmed that an Unauthorised Transaction has occurred, You should:

i. Report the Claim to Us as soon as possible and within thirty (30) days of the occurrence of the Unauthorised Transaction
ii. You are required to provide evidence for the Unauthorised Transaction from Your Eligible Card issuer, i.e. bank statements, payment card statements or other relevant documents. 
iii. You are required to disclose to Us all the information arising to the Claim

Terms and Conditions and Claim Provisions to Section C:

  1. We will only pay for an Unauthorised Transaction for which You are responsible according the terms and conditions of Your Eligible Card.
  2. You are required to report the loss of the Eligible Card and the Unauthorised Transaction to the police or relevant authority within twenty-four (24) hours of discovery of the burglary, theft or stolen and retain documentary evidence, such as a police report for use in support of Your Claim.
  3. You are required to comply with all the terms and conditions set out by Your Eligible Card issuer.
  4. Your Eligible Card must be valid and in good standing; We will not pay any Claim if, on the date of occurrence of the Unauthorised Transaction, on the date of Claim filing, or on the date of would-be Claim payment, Your Eligible Card is in delinquency, collection, or cancellation status.

Section D: Unauthorised Transaction Cover 

In the event Your Eligible Card is skimmed or cloned at the point of sale or ATM, and/or You identified or noticed an Unauthorised Transaction had occurred on Your Eligible Card while it is still in Your possession, We will reimburse You for all the Unauthorised Transactions which occurred within two (2) months prior to You first reporting the Unauthorised Transaction to the Eligible Card issuer, provided that You are required by the Eligible Card issuer to responsible for the Unauthorised Transaction.

In the event an Unauthorised Transaction is incurred on Your Eligible Card:

  1. You are required to report the Unauthorised Transaction to Your Eligible Card issuer within twenty-four (24) hours of discovery.
  2. You are required in the first instance to contact the Eligible Card issuer and query any Unauthorised Transaction to Your Eligible Card.
  3. If after the investigation by the Eligible Card issuer, it is confirmed that an Unauthorised Transaction has occurred, You should:
    i.         Report the Claim to Us as soon as possible and within thirty (30) days of the Unauthorised Transaction incurred.
    ii.       You are required to provide evidence for the Unauthorised Transaction from Your Eligible Card issuer, i.e. bank statements, payment card statements or other relevant documents.
    iii.     You are required to disclose to Us all the information arising to the Claim.

Terms and Conditions and Claim Provisions to Section D

  1. We will only pay for an Unauthorised Transaction for which You are responsible according the terms and conditions of Your Eligible Card.
  2. You are required to report the Unauthorised Transaction to the police or relevant authority within twenty-four (24) hours of discovery and retain documentary evidence, such as a police report for use in support of Your Claim.
  3. You are required to comply all the terms and conditions set out by Your Eligible Card issuer.
  4. Your Eligible Card must be valid and in good standing; We will not pay any Claim if, on the date of occurrence of the Unauthorised Transaction, on the date of Claim filing, or on the date of would-be Claim payment, Your Eligible Card is in delinquency, collection, or cancellation status.

Exclusions under Section C & D:

We will not pay any benefit for:

  1. Any loss other than those mentioned under Unauthorised Transaction.
  2. Any cash advances made with Your Eligible Card.
  3. Any Unauthorised Transaction which is incurred after You first report the loss of the Eligible Card to Your Eligible Card issuer.
  4. The loss of Eligible Card and the Unauthorised Transaction was not reported to the police within twenty-four (24) hours of discovery of the burglary, theft or stolen and You failed to obtain a written police report.
  5.  Charges incurred by a relative or a member of Your immediate family, or by a person You have authorised to use Your Eligible Card.
  6. Any loss that results from, or relate to, business pursuits including Your work or profession.
  7. Any transactions made using the “Verified by Visa” or “MasterCard Secure Code” service or any similar card security service.
  8. If Your Eligible Card was lost in a vehicle where Your Eligible Card was in plain sight regardless if the vehicle is locked or unlocked.
  9. Any transactions made via a phone banking application.
  10. Any transactions where a PIN and /or password is used.
  11. Any loss and/or an Unauthorised Transaction following skimming or cloning of an Eligible Card due to:
    i.         The Eligible Card having been delivered to a recipient other than the Insured Person;
    ii.        The Eligible Card issuer failing to comply with the contractual obligations with the relevant governing bodies;
    iii.      The fraudulent acts committed or misuse of any data or databases under the control of the Eligible Card issuer or by its employees or dependents; or
    iv.      Any failure in the software or hardware under the control of the Eligible Card issuer.

PART 5: GENERAL EXCLUSIONS

These General Exclusions apply to the whole of the policy unless otherwise stated. This policy does not cover losses under any sections of these terms and conditions which are recoverable from any other sources, or arising from:

  1. The first amount of every successful Claim (the Excess), wherever applicable.
  2. Any loss not incurred during the Period of Insurance.
  3. Any Eligible Item purchased prior to the successful enrolment of this policy. In the event of any dispute or difference arising out of, or in connection with, the application time of this policy, the time stamp recorded on Our system shall prevail and be final.
  4. Coverage will be voided, whether before or after the loss, if You or a member of Your immediate family have wilfully concealed or misrepresented any material fact or circumstance concerning this insurance or provided fraudulent information to Us.
  5. We have no duty to provide coverage under this policy unless there has been full compliance with the duties.
  6. You do not use all reasonable means to avoid future loss.
  7. In any action, suit or other proceedings where We allege that by reason of provision of any exclusion which may be applicable, any loss or damage that is not covered by this policy, the burden of proving that such loss or damage is covered shall be on You.
  8. For each of the coverages, regardless of the number of Claim made individually or in aggregate, We will pay up to the maximum amount per occurrence and per annual aggregate as shown in the schedule of benefit.
  9. War, invasion, act of foreign enemy hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power, nationalisation, confiscation, requisition, seizure or destruction by the government or any public authority.
  10. Any Claim resulting from ionising or contamination by radioactivity from any nuclear fuel or any nuclear waste from the combustion of nuclear fuel.
  11. Natural disasters, including (but not limited to) fire, flood, earthquake, storm, lightning, hurricane, tsunami or other natural disaster.
  12. Any dishonest or criminal activity.
  13. An Insured Person’s failure to mitigate loss or Claim under this policy.

PART 6: GENERAL CONDITIONS

  1. Assignment: No assignment of interest under this policy shall be binding upon The Company.
  2. Breach of Conditions: If the Insured Person is in breach of any of the conditions or provisions of the policy (including a Claim condition), We may decline to pay a Claim, to the extent permitted by law.
  3. Cancellation:
    a.       By Insured Person, no refund for any cancellation of this policy.
    b.       By The Company, We may cancel the policy at any time by giving You at least seven (7) days prior notice in writing to Your address on file, and in accordance with the law, including where You have:
    i.         made a misrepresentation to Us before the policy was entered into;
    ii.       failed to comply with Your Duty of Disclosure;
    iii.     failed to comply with a provision of Your policy including failure to pay the premium;
    iv.      made a fraudulent Claim under Your policy or any other policy during the time Your policy has been in effect;
    v.        failed to notify Us of a specific act or omission as required by Your policy; or
    vi.      failed to tell Us about any changes in the circumstances of the risk during the Period of Insurance.

    In the event of cancellation under b. i, ii, iv-vi , We will return promptly any premium actually paid by You.
  4. Changes in Policy: No change in this policy will be valid unless agreed to in writing by The Company. The requirements of any section of the policy may not be deemed to be waived unless The Company agrees to waive them in writing.
  5. Claims Investigation: In the event of a Claim, The Company may make any investigation it deems necessary and the Insured Person shall co-operate fully with such investigation. Failure by the Insured Person to co-operate with The Company’s investigation may result in denial of the Claim.
  6. Clerical Error: Clerical errors by The Company shall not invalidate insurance otherwise valid nor continue insurance otherwise not valid.
  7. Compliance with Applicable Economic and Trade Sanctions Laws: This insurance does not apply to the extent that trade or economic sanctions or other laws or regulations prohibit us from providing insurance, including, but not limited to, the payment of claims. All other terms and conditions of the policy remain unchanged.
    Chubb Insurance Hong Kong Limited is a subsidiary/branch of a US company and Chubb Limited, a NYSE listed company. Consequently, Chubb Insurance Hong Kong Limited is subject to certain US laws and regulations in addition to EU, UN and Hong Kong sanctions restrictions which may prohibit it from providing cover or paying claims to certain individuals or entities or insuring certain types of activities related to certain countries such as Cuba.
  8. Currency: The Sum Insured, benefits and limit of liability stated in the Schedule of Benefits and this policy are expressed in Hong Kong dollars. Notwithstanding the first sentence of this policy, losses and/or benefits will be adjusted and paid in Hong Kong dollars or at The Company’s option in the currency of the local country. When currency conversion is necessary when applying terms and conditions of the policy, the rates of exchange to be adopted shall be those prevailing at the date of loss as per the exchange rate at the median level quoted on www.oanda.com.
  9. Dispute Resolution: Any dispute or difference arising out of, or in connection with, this policy must first be referred to mediation at the Hong Kong Mediation Centre (HKMC) and in accordance with the HKMC’s mediation rules. If the mediation is abandoned by the mediator or otherwise ends without the dispute or difference being resolved, the dispute or difference must be referred to, and resolved by, arbitration at the Hong Kong International Arbitration Centre (HKIAC) and in accordance with the HKIAC’s domestic arbitration rules. If The Company refuses to pay any Claim under this policy and a dispute or difference arising from that refusal is not referred to mediation and, if necessary, arbitration, within twelve (12) months from the date of refusal, any Claim against The Company arising from that dispute or difference will be barred.
  10. Duplicate Coverages: Each Insured Person agrees that, if they are covered under more than one PurchaseOne Protection or same coverages under other policy issued by The Company:
    a.     The Company will consider the Insured Person to be insured under the policy which provides the highest amount of benefit; or
    b.     The Company will consider the Insured Person to be insured under the policy which was issued first if the benefit amount is the same.
    Only applicable if enrolled same insurance product: In any case, The Company will refund the premium paid, without interest, to the Insured Person for the policy that does not provide cover.
  11. Duty of Disclosure: Before You enter into Your policy with Us, You must disclose fully and faithfully all the facts which You know or ought to know, which are relevant to Us in providing insurance to You and the premium We calculate. If You do not do so, We may have rights to cancel this insurance, or to refuse to pay Your claims or You may receive no benefit from the policy.
  12. Entire Contract: This policy, together with its endorsement(s), attachment(s) (if any), any application form completed by an Insured Person, together with any document(s) attached to that application form or referred to in it, comprise and constitute the entire contract of insurance. This policy shall not be modified except by written amendment signed by an authorized representative of The Company.
  13. ExcessYou must pay the amount of any applicable Excess shown in the Policy Schedule or in this policy in respect of each Claim You make under the policy. The Excess is payable by You at such time required by The Company. If any event leads to a Claim under more than one Section of the policy, You must pay the highest applicable Excess.
  14. Fraud or Mis-statement: Any false statement made by an Insured Person or concerning any Claim shall result in The Company having the right to void this policy or repudiate liability under it.
  15. Geographical Limit and Operative Time: The geographical limit and operative time shall apply twenty-four (24) hours a day anywhere in the world during the Period of Insurance.
  16. Inspection and Salvage: If You make a claim, The Company may inspect the property or item. While The Company has no obligation to take possession of any damaged property or item, The Company reserves the right to do so. The Company is entitled to obtain and retain any property or items that are salvaged or recovered after it pays a claim by replacing or paying to replace such property or items. The Company may sell the property or items and keep the proceeds.
  17. Interest: No amounts payable by The Company under this policy shall carry interest.
  18. Interpretation of this Policy: Please note that the English version of this policy is the official version. This policy has been provided to You in both English and Chinese languages for ease of reference only. The English version of the policy will prevail if any dispute arises regarding the interpretation of any part of the policy.
  19. Jurisdiction: This policy shall be governed and construed in accordance with the laws of Hong Kong. Subject to General Condition 18, any dispute under this policy shall be settled in accordance with the laws of Hong Kong.
  20. Legal Action: No legal action shall be brought to recover on this policy until sixty (60) days after The Company has been given written proof of loss.  No such action shall be brought after three (3) years from the date of loss.
  21. Notice and Sufficiency of Claim: Written notice of Claim must be given to The Company as soon as is reasonably possible and in any event within thirty (30) days from the first day of the event giving rise to the Claim under this policy. Notice given by or on behalf of an Insured Person to The Company with information sufficient to identify the Insured Person shall be deemed valid notice to The Company. The Company, upon receiving a notice of Claim, will provide to an Insured Person such forms as it usually provides for filing proof of Claim. The Insured Person shall, at his/her own expense, provide such certificates, information and evidence to The Company as it may from time to time require in connection with any Claim under this policy and in the form prescribed. Proof of all Claim must be submitted to The Company within one-hundred-eighty (180) days from the first day of the event giving rise to a Claim.
  22. Notice of Trust or Assignment And Third Party RightsThe Company shall not be bound or be affected by any notice of any trust, charge, lien, assignment or other dealing with or in relation to this policy.
    A person who is not a party to this policy contract shall have no right to enforce any of its terms, other than any rights conferred by law.
  23. Other Insurance: To the extent permitted by law, when other insurance applies to a covered loss, We will pay only in excess of the other insurance, limited to the indemnity being provided under Your policy, unless that other insurance was specifically written as an excess over the indemnity provided in Your policy.
  24. Payment of Benefits: You may not be covered under more than one policy. If You are covered under more than one such policy, We will consider that person to be covered under the policy which provides the highest benefit(s). Where the benefit(s) under any additional policy are identical, We will consider that person to be insured under the policy first issued. All policy not recognised by Us shall be cancelled.
  25.  Premium: The Company has no liability under this policy until the premium is paid.  The premium is deemed to be fully earned on the date this policy is purchased. No refund of premium shall be allowed once the policy has been issued.
  26. Renewal of Your Policy: Subject to the terms and conditions of this policy, this policy may be renewed by payment of premium in advance or in accordance to the Premium Payment Warranty Clauses as applicable upon receiving our Renewal Notice. Unless We receive a copy of the Renewal Notice with the instructions to renew the policy prior to the expiry of the policy, the policy will terminate on the expiry date.
  27. Right of Recovery: In the event payment is made by Us for a Claim whereby policy liability is not engaged, We reserve the right to recover against You the full sum which was paid by Us to You for the Claim.
  28. SanctionYour policy does not apply to the extent that trade or economic sanctions or other laws or regulations prohibit Us from providing insurance, including, but not limited to, the payment of Claim. All other terms and conditions of the policy remain unchanged. Chubb Insurance Hong Kong Limited is a subsidiary/branch of a US company and Chubb Limited, a NYSE listed company. Consequently, Chubb Insurance Hong Kong Limited is subject to certain US laws and regulations in addition to European Union, United Nations, United Kingdom and Hong Kong sanctions restrictions which may prohibit it from providing cover or paying Claims to certain individuals or entities or insuring certain types of activities related to certain countries such as Cuba.
  29. Subrogation: If We make a payment under this policy, all Your rights of contribution, indemnity or recovery will be subrogated to Us. You must not surrender any right to or settle any claim for contribution, indemnity or recovery without Our prior written consent. You must do all things and execute all documents to enable Us to sue in Your name for such contribution, indemnity or recovery. Where You have agreed with another person or company (who would otherwise be liable to compensate You for any loss or damage which is covered by the contract of insurance) that You will not seek to recover such loss or damage from that person, We will not cover You, to the extent permitted by law, for such loss or damage.
  30. Sum Insured under each Section: Once the Sum Insured available to an Insured Person under any Section of this policy has been exhausted, that Sum Insured will not be reinstated and The Company will have no further liability under that Section to that Insured Person. For each of the coverages, regardless of the number of Claim made individually or in aggregate, We will pay up to the maximum Sum Insured per occurrence and per annual aggregate as shown in the Schedule of Benefits.

PART 7: HOW TO MAKE A CLAIM

You can complete a Claim form and submit together with the following required documents to Chubb Insurance Hong Kong Limited within thirty (30) days of the event taking place:

  • Original receipts, including date of purchase, price, model and proof of credit card payment.
  • Photos of the damaged items showing the extent of the damage. 
  • All bills, receipts and coupons.

Section A - Purchase Protection Cover

  • Copy(ies) of Invoices and / or receipts relating to Eligible Item.
  • Police investigation report in case of a Burglary or Robbery Claim including police reference number.
  • Duly completed claim form.
  • Any other relevant documents We may ask You and/or the Policyholder to provide.

Section B - Buyer’s Protection Cover

  • Copy(ies) of invoices and / or receipts relating to the Eligible Item.
  • Duly completed claim form.
  • Any other relevant documents We may ask You and/or the Policyholder to provide.

Section C - Card Theft & Loss

  • Duly completed claim form.
  • Police investigation report in case of a burglary, theft or stolen including police reference number.
  • Insured Person’s statement of account showing that the Eligible Card is in good standing at the time of making the Claim.
  • Any other relevant documents We may ask You and/or the Policyholder to provide.

Section (D) Unauthorised Transaction Cover

  • Duly completed claim form.
  • Police investigation report including police reference number.
  • Insured Person’s statement of account showing that the Eligible Card is in good standing at the time of making the Claim.
  • Any other relevant documents We may ask You and/or the Policyholder to provide.

PART 9 : PERSONAL INFORMATION COLLECTION STATEMENT

The Company (“We/Us”) want to ensure that Our Insured Person (“You”) are confident that any personal data collected by Us is treated with the appropriate degree of confidentiality and privacy.

This Personal Information Collection Statement sets out the purposes for which We collect and use personally identifiable information provided by You ("Personal Data"), the circumstances when Personal Data may be disclosed and information regarding Your rights to request access to and correction of Personal Data.

(a) Purposes of Collection of Personal Data

We will collect and use Personal Data for the purposes of providing competitive insurance products and services to You, including considering Your application(s) for any new insurance policies and administering policies to be taken out with Us, arranging the cover and administering and managing Your and Our rights and obligations in relation to such cover. We also collect the Personal Data to be able to develop and identify products and services that may interest You, to conduct market or customer satisfaction research, and to develop, establish and administer alliances and other arrangements with other organisations in relation to the promotion, administration and use of Our respective products and services. We may also use your Personal Data in other ways with your consent.

(b) Direct marketing

Only with your consent, We may also use your contact, demographic, policy and payment details to contact You with marketing information regarding our insurance products by mail, email, phone or SMS

(c) Transfer of Personal Data

Personal Data will be kept confidential and We will not sell Your Personal Data to any third party. We limit the disclosure of Your Personal Data but, subject to the provisions of any applicable law, Your Personal Data may be disclosed to:

(i) third parties who assist Us to achieve the purposes set out in paragraphs a and b above. For example, We provide it to Our relevant staff and contractors, agents and others involved in the above purposes such as data processors, professional advisers, loss adjudicators and claims investigators, doctors and other medical service providers, emergency assistance providers, insurance reference bureaus or credit reference bureaus, government agencies, reinsurers and reinsurance brokers (which may include third parties located outside Hong Kong); 

(ii) Our parent and affiliated companies, or any company within Chubb local and outside Hong Kong

(iii) the insurance intermediary through which You accessed the system; 

(iv) provided to others for the purposes of public safety and law enforcement; and 

(v) other third parties with your consent.

With regard to the above transfers of Personal Data, where applicable, You consent to the transfer of Your Personal Data outside of Hong Kong.

(d) Access and correction of Personal Data

Under the Personal Data (Privacy) Ordinance ("PDPO"), You have the right to request access to and correction of Personal Data held by Us about You and We will grant You access to and correct Your Personal Data as requested by You unless there is an applicable exemption under the PDPO under which We may refuse to do so. You may also request Us to inform You of the type of Personal Data held by Us about You.
